    Attorney-client privilege in criminal proceedings in the EU: need for common standards


    Sebbene il diritto al segreto professionale tra avvocato e cliente (c.d. “attorney-client privilege”) sia da tempo riconosciuto nel panorama giuridico europeo come un diritto fondamentale, nella pratica - come risulta evidente, in particolare, nell’ambito di indagini cross-border - la sua protezione non sembra essere effettiva e adeguata. È tuttavia possibile (e auspicabile) che l’Unione Europea, partendo da standard comuni rintracciabili a partire dalla giurisprudenza della Corte Europea dei Diritti dell'Uomo e della Corte di Giustizia Europea, intervenga per disciplinare la materia introducendo regole armonizzate per tutti gli Stati membri.
