    Coronavirus, Racanelli: "Seri dubbi su processi da remoto"


    "I processi da remoto? Ho seri dubbi sulla loro fattibilità e faccio miei i rilievi delle Camere penali". Antonello Racanelli, procuratore aggiunto del Tribunale di Roma e già componente del Csm si sofferma sul tema della gestione della giustizia al tempo del Coronavirus. Lo fa intervenendo nel meeting svoltosi interamente sul web "La Reputazione. Come tutelare il 'grande capitale' nell'era dell'innovazione?" organizzato da The Skill con la partecipazione dell'avvocato Gianluca Massimei (Nctm Studio Legale), dell'avvocato Fabio Pinelli dello studio Pinelli Avvocati e di Francesco Giorgino, giornalista del Tg1 e docente alla Luiss Guido Carli. "Pensiamo alla difficoltà di gestire le camere di consiglio in Corte di Assise, ci sono forti rischi di condizionamento" continua Racanelli. "L'innovazione è importante, ma comporta problemi notevoli".

    Nel corso del dibattito Francesco Giorgino ha spiegato che "il Ventunesimo secolo sarà il periodo della micronarrazioni che sostituiranno le macronarrazioni e saranno basate su alcune parole chiave: fiducia, credibilità, personal branding, brand identity e tutela e mantenimento della reputazione". L'avvocato Gianluca Massimei ha sottolineato come sia "necessario rivedere la normativa relativa alle diffamazioni a mezzo social media ai danni delle aziende, diffamazioni agevolate dall'anonimato". L'avvocato Fabio Pinelli, infine, ha invitato a elevare "il reato di diffamazione a reato primario e fare in modo che la tutela sia effettiva. Sarebbe importante che anche i giornalisti si ponessero il problema a tutela della verità dell'informazione". In questo senso Pinelli e Massimei si dicono "d'accordo sulla creazione di sezioni specializzate con tempi immediati per la tutela della reputazione e della dignità altrimenti del tutto intempestiva per assicurare una effettiva tutela giuridica sia sul piano civile sia soprattutto, come oggi, sul piano penale".
