    Diritto di satira e detti popolari


    La Corte di Cassazione con sentenza n. 6786/2016 è intervenuta sulla liceità dell’utilizzo di detti popolari in chiave satirica. In particolare il caso aveva ad oggetto un’azione per risarcimento danni da diffamazione a mezzo stampa esercitata da un parlamentare nonché autore di alcune pubblicazioni conseguente alla risposta pubblicata dal direttore dell’edizione telematica di un noto quotidiano italiano. In particolare un lettore aveva chiesto se il direttore ritenesse che la vicenda del predetto parlamentare-scrittore, che si era scoperto aver collaborato con il SISMI, potesse essere equiparata ad un altro ben più un famoso caso di scrittore-spia, ovvero quello di Ernest Hemingway. Il direttore, per stigmatizzare, la differenza tra le due vicende, aveva citato un detto milanese, ripreso spesso dal celebre comico meneghino Gino Bramieri, secondo cui non bisogna confondere il risotto con gli escrementi. Il Supremo Collegio, rammentato che il diritto di satira al contrario del diritto di cronaca si sottrae al parametro della verità del fatto, ha ritenuto che la locuzione utilizzata dal direttore costituisse legittimo esercizio del diritto di satira, in quanto avente una valenza iperbolica e grottesca, percepibile dal lettore, finalizzata a porre in risalto l’incomparabilità della vicenda oggetto di analisi e quella, ovviamente di maggiore preminenza sul piano storico ed artistico, del premio Nobel Hemingway. Per la Suprema Corte una siffatta elaborazione satirica deve essere ritenuta lecita, allorquando il destinatario sia un personaggio pubblico in relazione al quale è fisiologica una maggiore esposizione mediatica (limite interno) ed il messaggio satirico sia causalmente collegato alla sua dimensione pubblica (limite esterno).
