    Certificazione TCF: una nuova opportunità per i legali


    L’avvio dell’albo dei certificatori dei Tax Control Framework (TCF), previsto dal decreto ministeriale n. 212/2024, apre un nuovo ambito professionale anche per gli avvocati. Il nuovo sistema consente alle imprese di accedere al regime di adempimento collaborativo con l’Agenzia delle Entrate attraverso la certificazione dei modelli di gestione del rischio fiscale.

    Su questi temi è intervenuto Luca La Barbera, partner di ADVANT Nctm, intervistato da Italia Oggi Sette – Affari Legali, evidenziando sfide e opportunità per la professione forense.

    «Affidare ai professionisti forensi il delicato ed importante compito di certificare o attestare i modelli TCF rappresenta allo stesso tempo una sfida e un'opportunità. Introducendo l'obbligo di certificazione come presupposto per l'ammissione al regime di adempimento collaborativo, il legislatore ha voluto affidare ad un professionista esterno ed indipendente il delicato compito di garantire la solidità e il buon funzionamento del modello di gestione del rischio fiscale. L'attività di certificazione, pertanto, presuppone capacità e competenze per inserirsi in modo utile ed efficace nella relazione già impostata tra l'azienda e il professionista che la assiste nella costruzione del TCF, senza creare duplicazioni e appesantimenti e allo stesso tempo, eseguendo in modo accurato ed attento l'attività di analisi e valutazione fino ad oggi svolta dall'Agenzia delle Entrate. 

    Un compito delicato che richiede non solo conoscenza approfondita della materia giuridico-fiscale, ma anche dimestichezza con i meccanismi ed i processi che regolano il funzionamento di organizzazioni complesse. Ancor di più, in considerazione dell'imminente abbassamento delle soglie di entrata (500 milioni di euro di fatturato), che verosimilmente amplierà il novero delle istanti ad aziende con processi ed organigrammi più snelli, dove spesso la responsabilità per la gestione della fiscalità è, in tutto o in parte, affidata ad un consulente esterno.

    Una sfida, certo, ma anche un'imperdibile opportunità per portare valore concreto, contribuendo a creare un nuovo contesto in cui contribuente e amministrazione lavorano insieme alla costruzione un rapporto fiduciario basato su interlocuzioni trasparenti, costanti e preventive».
