    Composizione negoziata – Misure cautelari – Inibizione dell’escussione di garanzie pubbliche

    Il Tribunale di Modena ha accolto la misura cautelare di inibitoria dell’escussione di garanzie pubbliche, non tanto per evitare la maturazione del privilegio conseguente all’escussione, quanto piuttosto per facilitare le trattative da proseguire con il finanziatore garantito (rispetto alle complessità dei rapporti con il garante pubblico) e, inoltre, per consentire di approfondire la verifica della non abusività della concessione di credito in considerazione della garanzia ottenuta dalla banca.

    Si consolida l’orientamento di merito che inibisce in via cautelare l’escussione di garanzie di terzi: per quanto riguarda le garanzie pubbliche, in un precedente inedito del Trib. Ravenna l’inibitoria era stata concessa per evitare il consolidarsi del “super-privilegio”, ciò che invece correttamente il Trib. Modena lascia in disparte. Interessante poi la motivazione modenese che richiama il tema emergente della contestazione della validità della garanzia pubblica e della verifica che la banca non abbia concesso abusivamente il credito a fronte della stessa.
