    Linee di credito con garanzia MCC – Nullità per contrarietà a norme penali e al buon costume – Non ripetibilità delle somme

    La concessione di finanziamenti assistiti da garanzia pubblica che si risolva oggettivamente in un aggravamento del dissesto di un imprenditore in assenza di ragionevoli prospettive di superamento della crisi, con violazione delle regole di valutazione del merito creditizio da parte della banca, determina la nullità del contratto ai sensi dell’art. 1418 c.c. per contrarietà a norma penale.

    La decisione si inserisce nell’orientamento di merito maggioritario che riconosce la nullità del contratto (Trib. Torino e Asti), prendendo espressamente posizione anche sulla esclusione del diritto al rimborso del capitale per contrarietà al buon costume (art. 2035 c.c.) inteso anche come violazione delle regole di correttezza di mercato (Cass. n. 16706/2020), con la conseguente esclusione del credito dal passivo.
