    Misure cautelari – composizione negoziata

    Il Tribunale di Padova ha concesso le misure cautelari, aventi il medesimo contenuto delle misure protettive tipiche non più rinnovabili dopo il decorso del termine massimo di 240 giorni, richieste della debitrice in composizione negoziata nei confronti di taluni creditori. 

    Dopo una recente pronuncia in senso contrario (Trib. Roma 14 maggio 2025), riprende vigore l’orientamento che ritiene invece ammissibili le misure cautelari, secondo l'interpretazione più ragionevole a tutela del debitore. A sostegno di questa interpretazione va ricordato che l'efficacia delle misure cautelari presuppone sempre l'accertamento in contraddittorio con il creditore della necessità delle misure richieste per addivenire alla soluzione della crisi e, inoltre, che le misure cautelari, per propria natura, sono atipiche nel contenuto e devono poter rispondere alle esigenze del caso di specie, senza rigide limitazioni.
