    Un primo passo per il riordino delle sanzioni


    Il Governo ha di recente varato la bozza di decreto legislativo per la riforma delle sanzioni amministrative e penali previste dal Testo Unico della Finanza (Tuf).

    Il punto di partenza di questa riforma è spiegato da Lukas Plattner, partner di ADVANT Nctm, il quale evidenzia il “paradosso italiano”: “Nel 2024 l'Italia è risultata il primo Paese in Europa per numero di sanzioni amministrative irrogate in materia di abusi di mercato (ben 80), ma non è stata irrogata alcuna sanzione penale, replicando una dinamica già vista nel 2023. Questo scenario descrive un "doppio binario" sanzionatorio fortemente asimmetrico, in cui l'iter amministrativo procede speditamente, mentre i procedimenti penali restano fermi al palo a causa di complessità strutturali, carichi di lavoro elevati per le Procure e forse violazioni bagatellari".
