    Adempimenti necessari per la validità delle notifiche a soggetti temporaneamente irreperibili - Irreperibilità assoluta e relativa nella notificazione degli atti impositivi


    Abstract

     

    La sentenza della Commissione tributaria regionale dell’Abruzzo n. 957/2019 offre lo spunto per rimarcare l’esigenza di operare una rigorosa distinzione tra le ipotesi di irreperibilità c.d. assoluta e le ipotesi di irreperibilità c.d. relativa in sede di notifica degli atti impositivi. La corretta individuazione del confine tra le due fattispecie - spesso inopinatamente assimilate nella prassi degli agenti notificatori - risulta essenziale ai fini della legittimità della notifica - e, dunque, della produzione degli effetti giuridici dell’atto notificando - attesa la diversità degli adempimenti all’uopo imposti dalla normativa di riferimento.
